Welcome to Nearpie. These Terms and Conditions ("Terms") govern your access to and use of the Nearpie mobile application, website, and related services (collectively, the "Services"). By creating an account, accessing, or using the Services, you agree to these Terms. If you do not agree, do not use Nearpie.
1. Eligibility
You must be at least 13 years old to use Nearpie. If the law where you live requires a higher minimum age or parent or guardian consent, you may use Nearpie only if those requirements are satisfied. By using the Services, you confirm that you meet these requirements and that you are legally able to agree to these Terms.
2. Accounts and Security
You may need an account to use Nearpie. You agree to provide accurate information and keep your account information up to date.
You are responsible for activity that occurs through your account. Keep your login credentials secure and notify us if you believe your account has been accessed without permission.
We may use authentication, Firebase App Check, rate limits, abuse prevention, and similar safeguards to protect users and the Services.
3. What Nearpie Provides
Nearpie helps users discover and share what is happening nearby. Features may include local posts, location feeds, profiles, comments, likes, shares, events, carpool posts, lost and found posts, direct chat, push notifications, location search, media uploads, and shared links.
Some features depend on your location, device permissions, internet connection, third-party services, and user-generated content. We do not guarantee that every feature will always be available, accurate, current, or error-free.
4. User Content
"User Content" means anything you post, upload, send, or otherwise provide through Nearpie, including text, images, videos, profile information, comments, replies, event details, carpool details, lost and found details, chat messages, and location-related information.
You are responsible for your User Content. You confirm that you have the rights needed to share it and that it does not violate law, these Terms, or anyone else's rights.
By submitting User Content, you grant Nearpie a non-exclusive, worldwide, royalty-free license to host, store, display, distribute, reproduce, adapt, and use that content as needed to operate, secure, improve, and promote the Services. This license ends when the content is deleted from our active systems, except where retention is needed for backups, legal, safety, moderation, or legitimate business purposes.
5. Anonymous and Local Posting
Nearpie may allow anonymous posts, comments, or replies. Anonymous features are intended to limit public display of your identity, but they do not make activity invisible to Nearpie systems. We may retain private author records where needed for safety, moderation, abuse prevention, account deletion, and legal compliance.
6. Location-Based Features
Nearpie uses location-related information to show nearby posts, places, events, carpools, lost and found items, recommendations, and local feeds. You should not use Nearpie to stalk, harass, track, threaten, or harm another person.
Do not post precise personal locations, private addresses, sensitive locations, or information that could put someone at risk unless you have the right and a safe reason to do so.
7. Events, Carpool, and Lost and Found
Event, carpool, and lost and found posts are user-generated. Nearpie does not verify every listing, host, rider, item, time, route, or location.
Use your own judgment before meeting people, traveling, sharing contact information, exchanging items, or relying on any user-provided listing. You are responsible for complying with applicable laws and safety practices.
Nearpie is not a transportation provider, event organizer, emergency service, lost property authority, insurer, or background-check service.
8. Direct Chat and Communications
Nearpie may allow users to send direct messages and media. You agree not to use chat or other communication features to harass, threaten, spam, scam, exploit, impersonate, or abuse others.
You are responsible for the content you send and for your interactions with other users.
9. Prohibited Conduct
You agree not to:
- Use Nearpie for unlawful, harmful, fraudulent, deceptive, or abusive purposes.
- Post content that is illegal, hateful, violent, sexually exploitative, harassing, defamatory, invasive of privacy, or otherwise harmful.
- Threaten, stalk, bully, intimidate, or target another user.
- Share another person's private or sensitive information without permission.
- Impersonate another person or misrepresent your identity or affiliation.
- Upload malware, harmful code, or content designed to disrupt systems.
- Try to bypass security controls, Firebase App Check, rate limits, quotas, or access rules.
- Scrape, crawl, copy, reverse engineer, or misuse the Services except as allowed by law.
- Interfere with the operation, integrity, or security of the Services.
- Use Nearpie to send spam, unsolicited promotions, or deceptive links.
- Create duplicate, fake, or abusive accounts.
- Misuse events, carpool, lost and found, or chat features in a way that risks user safety.
10. Moderation and Enforcement
We may review, restrict, remove, or refuse content, accounts, or activity that we believe violates these Terms, creates risk, harms users, or may expose Nearpie to liability.
We may suspend, limit, or terminate your account or access to the Services at any time, with or without notice, where permitted by law.
Nearpie also publishes standards against child sexual abuse and exploitation that apply to all users and content.
11. Intellectual Property
Nearpie, including its name, logo, design, software, features, text, graphics, and other materials, is owned by or licensed to Nearpie and is protected by intellectual property laws.
You may not copy, modify, distribute, sell, lease, or create derivative works from any part of the Services unless we give you written permission or the law allows it.
12. Third-Party Services
Nearpie uses third-party services such as Firebase, Google Maps, analytics, crash reporting, cloud hosting, push notification services, app stores, and device operating system services. Your use of those services may also be subject to their terms and policies.
We are not responsible for third-party services, websites, content, policies, or availability.
13. Privacy
Our Privacy Policy explains how we collect, use, share, and protect information. By using Nearpie, you also agree to our Privacy Policy.
14. Account Deletion
You may request deletion of your account and associated personal data through available in-app features or by contacting us. See our Account Deletion page for deletion steps and details about associated data. Some information may be retained where necessary for legal compliance, security, fraud prevention, backups, dispute resolution, or legitimate business purposes.
15. Disclaimers
The Services are provided "as is" and "as available." To the maximum extent permitted by law, Nearpie disclaims all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, security, and non-infringement.
Nearpie does not guarantee that user content, location information, maps, recommendations, listings, messages, notifications, or search results will be accurate, reliable, safe, complete, or current.
16. Limitation of Liability
To the maximum extent permitted by law, Nearpie and its affiliates, owners, employees, contractors, and partners will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or other intangible losses arising from your use of or inability to use the Services.
17. Indemnity
You agree to defend, indemnify, and hold harmless Nearpie and its affiliates, owners, employees, contractors, and partners from claims, damages, liabilities, losses, and expenses arising from your User Content, your use of the Services, your violation of these Terms, or your violation of law or another person's rights.
18. Changes to the Services or Terms
We may change, suspend, or discontinue any part of the Services at any time. We may update these Terms from time to time. Updated Terms will be posted with a new "Last updated" date. Your continued use of Nearpie after updates means you accept the updated Terms.
19. Governing Law
These Terms are governed by the laws of India, without regard to conflict of law principles. Subject to applicable law, disputes relating to these Terms or the Services will be resolved in the courts of India.
